Experience

Advocate entered on the list of the Bar Association in Warsaw. He advises corporate and individual Clients in the real estate sector and construction investments, including in the field of renewable energy sources. Representative before public administration authorities and administrative courts. He specializes in public real estate law, monument protection law, environmental protection law, issues of the interface between civil and administrative law, as well as administrative and court-administrative proceedings.

He advised local government units on real estate management matters and cooperated as an expert with the Ministry of Administration and Digitization (the ‘Good Law - Efficient Government’ program), the State Accreditation Committee (currently: the Polish Accreditation Committee) and the Society for the Preservation of Historical Monuments, Branch in Warsaw.

Winner of a special award in the competition ‘Rising Stars Lawyers - Leaders of Tomorrow 2020’. In 2019, he was distinguished in the Legal 500 EMEA ranking with the Next Generation Lawyer title in the Construction category and in 2020 as well as 2021, he was individually recommended in this ranking as a specialist in the field of monument protection law.

Author of the first monograph on the publishing market on the procedure for updating the annual fee for perpetual usufruct (Wolters Kluwer 2013). Co-author of the Commentary to the Act on the Professions of Physician and Dentist (Wolters Kluwer 2016) and the monograph Tort Liability of Public Authorities in European Laws (Oxford University Press 2020). Editor of the monograph titled Directions of changes in the Code of Administrative Procedure. Proposals and controversies (Publishing House of the University of Warsaw 2014). Author of articles and commentaries for Dziennik Gazeta Prawna, Rzeczpospolita and the website Prawo.pl.

Realised projects

Among the projects carried out as part of the HANTON Szalc Zięba & Partners Law Firm as well as previous law firms, the following can be mentioned:

  • advising on administrative proceedings preceding the construction of: Nowy Sezam office building, Generation Park building ensemble, Atrium III, Wave, P180, Atrium Promenada, Synergia Olsztyn, Park Skandynawia housing estate, Mickiewicz housing estate, Jaśminowy Mokotów housing estate, Grzybowska 37 apartment building, including revitalization projects such as: Fabryka Norblin, the former Koneser Vodka Factory, Smyk Department Store in Warsaw, Soho Factory, the grounds of the former Gdańsk Shipyard;
  • legal representation of developers in a number of administrative proceedings, including these regarding the exclusion of land from agricultural production, geodetic division of real estate, water-rights permit, conservation permit to conduct construction works at the monument, determination of compensation for real estate expropriated for public road, granting a building permit;
  • advising and legal representation of local government units in matters related to the restitution of expropriated real estate and land de-agriculturalization;
  • authorship of comments and participation in many proceedings regarding the adoption of a local spatial development plan, as well as drawing up legal opinions on the interpretation of the content of local plans; representation in proceedings regarding the declaration of invalidity of the provisions of the local spatial development plan;
  • participation as a legal representative in proceedings regarding the determination of development conditions before administrative authorities and administrative courts, including for the Warsaw One and Nowa Emilia skyscrapers projects;
  • development of a strategy for the demolition of the Emilia pavilion in the context of proceedings for entry in the register of monuments and inclusion of the object in the provincial register of monuments, preparation of the project and participation in negotiations with the Capital City of Warsaw on an agreement regarding the transfer of Emilia pavilion’s elements, legal representation of the investor before an administrative court in a complaint against a permit to demolish Emilia pavilion;
  • advising and representation before monument protection authorities and the administrative court regarding the entry of real estate of a company from the Atrium European Real Estate group into the register of monuments, completed with an entry covering 10% of the original assumption;
  • obtaining an entry in the register of monuments of movable elements and platform shelters of the railway and bus station complex in Olsztyn and refusal to enter the entire complex in the register of historical monuments;
  • obtaining a complete set of conservator’s permits for the revitalization project of the headquarters of Bank Gospodarstwa Krajowego in Warsaw;
  • legal advising during the investment process of real estate located in the vicinity of historic buildings for, among others: HB Reavis Poland, Skanska Property Poland, Echo Investment, Soho Development;
  • conducting comprehensive legal audits of solar and wind farm projects for private entities and State Treasury companies;
  • participation, on the part of the investor, in the procedure for determining the environmental conditions for the implementation of the project consisting in the construction of a civilian airport in Warsaw-Modlin;
  • advising in proceedings regarding the construction and use of artificial islands in sea areas for the Baltica-1, Baltica-2 and Baltica-3 wind farms;
  • advising and legal representation for LS Airport Services S.A. before administrative authorities in proceedings regarding the removal of almost 1000 trees and shrubs, including exemption from paying the fee for the removal of trees and shrubs, for the construction of the DHL terminal at the Warsaw Chopin Airport;
  • legal representation of a number of companies, including public ones before administrative bodies and administrative courts in cases of administrative fines for the occupation of a road lane of public roads;
  • advising and representation in proceedings regarding the update of the annual fee for perpetual usufruct for the benefit of J.W. Construction Holding, Makton S.A., Polfer S.A .;
  • advising on the transformation of perpetual usufruct into the right of ownership as well as on changing the purpose of perpetual usufruct for the benefit of leading housing developers and individual Clients.
