HANTON Law Firm represented the client in the course of the tender for the operation of regional passenger rail transport in Podlasie
The law firm HANTON Szalc Zięba & Partners represented POLREGIO in a tender for the operation of regional rail passenger transport in the Podlaskie Voivodeship. The second of the law firms serving POLREGIO was K&K Mariusz Kuźma Beata Jagodzińska Kuźma - thank you for your cooperation.
The legal service ended with a positive verdict for the Client by the National Board of Appeals. The Chamber found the arguments presented by the Law Firm regarding the violation by the Ordering Party of the provisions of Polish and European Union law accurate. Analogous arguments were also presented by the other potential operator.
The appeal filed on behalf of the Client led primarily to positive changes in the methodology for determining the valorization of costs incurred by rail carriers. This made it possible to reduce the risk on the part of the operators and to calculate offers assuming adequate valorization of the contract in the event of an increase in operating costs.
